Welcome to ARKELY, an application developed by Jopad Officiel, a French company. By using our service, you agree to these terms of service.

1. Service Description

ARKELY is an artificial intelligence application that uses Google's Gemini API to provide real-time conversations with advanced audio, video, and text capabilities.

2. Use of Google Gemini API

2.1 Data Transmission

By using ARKELY, you understand and agree that:

  • All data you send through the interface (text, audio, video, images) is transmitted directly to Google's servers
  • This data is processed by Google's Gemini API according to their own policies and terms of service
  • Google may use this data to train and improve their artificial intelligence models

2.2 Limitation of Liability

Jopad Officiel is not responsible for Google's use of data transmitted through the Gemini API. We encourage you to review Google's privacy policy to understand how your data is processed.

3. Memory Data Storage

Memory data and conversation history are stored via Mem0, hosted on the cloud. This data is used solely for the application's functionality and is not used to train our own AI models.

4. Payment Processing

4.1 Stripe Integration

For subscription payments, we use Stripe as our payment processor. All banking and payment data is:

  • Stored securely on Stripe's servers
  • Protected by Stripe's industry-leading security measures
  • Subject to Stripe's terms of service and privacy policy
  • Not stored on our own servers

4.2 Payment Security

Jopad Officiel does not have access to your complete payment information. All sensitive payment data is handled exclusively by Stripe in compliance with PCI DSS standards.

5. Acceptable Use

You agree to:

  • Use the service legally and ethically
  • Not transmit illegal, offensive, or harmful content
  • Respect the rights of others
  • Not attempt to circumvent security measures

6. Intellectual Property

The ARKELY application and its interface are the property of Jopad Officiel. AI-generated responses are subject to Google Gemini's terms of service.

7. Warranty Disclaimer

The service is provided "as is" without warranty of any kind. Jopad Officiel does not guarantee continuous service availability or the accuracy of AI-generated responses.

8. Modifications to Terms

We reserve the right to modify these terms at any time. Changes will take effect upon publication on this page.
